Non-Exclusive Agreement
This is an agreement between the Seller and Broker that details the condition of listing. It is standard for Brokers to use an agreement. The features of the special offer listing agreement are:

(1) | According to WIKI, the 'normal' brokerage commission (success fee) for selling businesses above USD 100,000 in North America is between 10% and 12% of the transfer price. Some brokers also charge a retainer and/or other fees. The same similarly applies in the UK. In Australia, there is a growing trend in real estate to move away from the commission-based model (or at least reduce the percentage considerably) to a model where a Seller pays for what they want in terms of advertising and services. Regardless, in Australia right now, the commission rate for selling businesses is still around 10% Asia Business Brokers, headquartered in Bangkok, being the largest single business brokerage network in Asia by listing numbers, charges a flat 10% for sales up to USD 350,000 (and then scales down the commission based upon price). So what this means is to state "the 'normal' rate in Asia is 10%" is reasonable and consistent with other parts of the world. It should be noted that when a 'success commission' model is used, a Seller only pays to the broker who identifies and introduces the Buyer to them. |
